AI TRANSPARENCY NOTICE AND RESPONSIBLE AI DISCLOSURE
Welcome to Macaly.
1. INTRODUCTION
1.1 Purpose of this Notice. This AI Transparency Notice and Responsible AI Disclosure ("AI Transparency Notice") explains how artificial intelligence ("AI") is used within the Macaly platform and the Services. It also describes our approach to the responsible development and use of AI and provides information intended to support compliance with applicable laws relating to artificial intelligence, including Regulation (EU) 2024/1689 (Artificial Intelligence Act) (the "AI Act").
1.2 Who we are. We are LANGTAIL.COM s.r.o., ID No. 198 68 987, with its registered seat at Záhřebská 562/41, Vinohrady, 120 00 Prague 2, Czech Republic, registered in the Commercial Register maintained by the Municipal Court in Prague under file No. C 393016 ("we", "us" or "our"). We operate the website available at macaly.com (the "Platform" or "Macaly") and provide the related services, applications, software, features, AI-powered tools and integrations accessible through the Platform (collectively, the "Services").
1.3 What we do. We provide an AI-powered coding and website/application development platform that enables users to create, manage, modify and deploy code, websites, applications and related content. The Services may include generative AI functionality, AI agents, automated workflows, AI-generated content and integrations with Connected Third-Party Services.
1.4 Relationship with other documents. This AI Transparency Notice should be read together with our Terms of Service, Privacy Policy and, where applicable, our Data Processing Agreement. Unless otherwise defined in this AI Transparency Notice, capitalised terms have the meanings given to them in the Terms of Service, Privacy Policy and Data Processing Agreement.
2. HOW AI IS USED
2.1 AI-powered functionality. The Services use artificial intelligence to assist Customers and their Authorised Users with software development and related activities. Depending on the functionality selected by the Customer, AI may be used to:
- generate, analyse and modify source code;
- generate websites, applications and software components;
- explain, review and optimise code;
- generate documentation and technical content;
- automate development workflows;
- assist with debugging and troubleshooting;
- interact with Connected Third-Party Services authorised by the Customer; and
- perform other tasks requested through the Services.
2.2 Customer control. AI-powered functionality is activated only in response to instructions submitted by the Customer or its Authorised Users.
2.3 AI-assisted customer support. We may use AI-powered tools to assist in responding to customer support enquiries. AI-generated responses are intended to improve the efficiency and availability of customer support. Where appropriate, support interactions may involve review or assistance by our personnel.
3. AI SERVICE PROVIDERS
3.1 Third-party AI providers. To provide AI-powered functionality, we may use carefully selected third-party AI model providers and technology providers. These providers may include, among others:
- Anthropic;
- OpenAI;
- Google;
- Perplexity; and
- other providers identified in our Data Processing Agreement or otherwise made available through the Platform.
3.2 Processing by AI providers. Where necessary to provide the requested AI functionality, prompts, Customer Data, Generated Content and related information may be processed by such providers solely for the purpose of providing the requested Services and subject to appropriate contractual, technical and organisational safeguards.
3.3 AI services connected to Customer Applications. Third-party AI assistants or AI services that a Customer, its Authorised User or an End User independently connects to a Customer Application are distinct from the AI service providers engaged by us under Section 3.1. Such connections may be established through supported authentication or connection mechanisms, including OAuth or credentials generated and managed by the Customer, such as API or static access tokens. The relevant third-party AI service is used under the account and relationship of the Customer, Authorised User or End User establishing or using the connection, as applicable. We do not engage the relevant third-party provider on behalf of the Customer merely because the Customer Application enables such connection.
4. AI-GENERATED CONTENT
4.1 AI-generated outputs. The Services generate content using artificial intelligence. The Generated Content may include:
- source code;
- software components;
- documentation;
- technical explanations;
- configuration files;
- recommendations;
- workflow suggestions; and
- other outputs requested by the Customer.
4.2 Accuracy. Artificial intelligence is probabilistic technology. Accordingly, AI-generated outputs may contain inaccuracies, omissions, outdated information or unintended results. Customers should independently review, verify and test AI-generated outputs before deploying, relying upon or distributing them.
5. USE OF CUSTOMER DATA
5.1 Current processing activities. We currently process prompts, instructions, Customer Data, Generated Content and related information submitted to the Services for the purpose of providing, operating, maintaining, securing and supporting the Services.
5.2 AI model training. As of the effective date of this AI Transparency Notice:
- Customer Data is not used to train our AI models;
- prompts are not used to train our AI models;
- Generated Content is not used to train our AI models; and
- Customer Personal Data is not used for AI model training.
5.3 Future changes. Our Terms of Service contain certain contractual provisions that may permit the use of certain Generated Content and Customer Data for product or service improvement. As of the effective date of this AI Transparency Notice, we do not use Customer Data or Generated Content for general AI model training or general improvement of AI-powered functionality beyond the operational quality assurance, debugging, evaluation and reliability activities described in our Privacy Policy. If our processing activities change in the future, we will update this AI Transparency Notice and our Privacy Policy and, where required by applicable law, implement appropriate safeguards and obtain any necessary consents or rely on another lawful basis for processing.
6. HUMAN OVERSIGHT
6.1 Human responsibility. Macaly Platform is designed to assist Customers rather than replace human decision-making. Customers remain responsible for:
- reviewing AI-generated outputs;
- determining whether to use AI-generated content;
- supervising AI-assisted workflows;
- monitoring actions performed through Connected Third-Party Services;
- ensuring the accuracy and suitability of generated outputs; and
- complying with applicable legal and regulatory requirements.
6.2 Automated decision-making. Macaly Platform does not make decisions based solely on automated processing, including profiling, that produce legal effects concerning individuals or similarly significantly affect individuals within the meaning of Article 22 GDPR.
7. CONNECTED THIRD-PARTY SERVICES
7.1 AI interactions. Where authorised by the Customer, AI-powered functionality provided through the Services may access, retrieve, create, modify, analyse or transmit information within Connected Third-Party Services in accordance with the permissions configured by the Customer and its Authorised Users.
7.2 Connections of Customer Applications to third-party AI services. The Services may enable Customers to configure Customer Applications so that selected functions or tools can be accessed by third-party AI assistants or AI services. Such functionality is enabled by the Customer. A connection may be established by an End User through a separate authorisation flow or by the Customer or its Authorised User through other supported authentication mechanisms, including credentials generated and managed by the Customer. Where such a third-party AI service accesses a Customer Application, information returned by the functions made available through the Customer Application may be transmitted to and processed by the relevant third-party AI service. The subsequent processing of such information is subject to the relationship between the person or entity using the third-party AI service and the relevant provider and to that provider's terms and privacy practices.
7.3 Customer responsibility. Customers remain responsible for selecting and configuring the functions made available through Customer Applications, managing permissions and access controls, and ensuring that End Users are appropriately informed about the operation and consequences of any connections enabled by the Customer.
8. RESPONSIBLE USE OF AI
8.1 Our approach. We are committed to the responsible development and operation of AI-powered Services. We seek to:
- implement appropriate security measures;
- protect Customer Data;
- provide meaningful human oversight;
- maintain transparency regarding our AI-powered functionality;
- comply with applicable AI and data protection legislation; and
- monitor developments relating to artificial intelligence and responsible AI practices.
8.2 Continuous improvement. As our Services evolve, we may introduce additional technical safeguards, governance measures and transparency mechanisms designed to support the safe and responsible use of AI.
9. CUSTOMER RESPONSIBILITIES
9.1 Responsible use. Customers are responsible for ensuring that:
- they have all necessary rights and permissions to submit Customer Data to the Services;
- AI-generated outputs are appropriately reviewed before use;
- any applicable transparency obligations towards their own users are satisfied;
- AI-generated outputs are used in accordance with applicable law;
- where Customer Applications are configured to permit connections with third-party AI assistants or services, only functions and data that are intended to be made available through such connections are exposed and appropriate authentication and access controls are maintained;
- End Users are appropriately informed that information accessed through functions they authorise may be transmitted to and subsequently processed by the third-party AI service they choose to connect; and
- the Services are not used in a manner prohibited by our Terms of Service or applicable law.

11. FINAL PROVISIONS
11.1 Updates. We may update or amend this AI Transparency Notice from time to time to reflect changes in our Services, applicable laws, regulatory guidance, AI technologies or our AI practices.
11.2 Notification of changes. Where required by applicable law, we will notify you of material changes by appropriate means, including through the Platform or by another appropriate communication channel.
11.3 Effective date. The "Last updated" date at the beginning of this AI Transparency Notice indicates when this AI Transparency Notice was most recently revised.
11.4 Relationship with other documents. This AI Transparency Notice forms part of the legal framework governing your use of the Services and should be read together with our Terms of Service, Privacy Policy, Data Processing Agreement (where applicable) and any other policies or notices made available by us.
